As redes sociais têm sido usadas por influenciadores com milhões de seguidores para divulgar vídeos em que fazem doações a pessoas que precisam de ajuda.
Alguns deles, além das doações, fazem sorteios com vendas de números, com a promessa de reverter o valor arrecadado para projetos sociais.
Segundo especialistas, sorteios filantrópicos só podem ser realizados por empresas ou organizações da sociedade civil, e não por pessoas físicas, e dependem de autorização do Ministério da Fazenda.
Quando em desacordo com a lei, essa prática pode ser classificada como uma rifa, considerada uma contravenção penal (como acontece com o jogo do bicho). Isso porque a modalidade envolve pagar para participar de um jogo cujo resultado depende exclusivamente da sorte.
“O problema está no ato de pagar por um número em troca da mera possibilidade de receber um prêmio que você não tem como controlar”, explica o advogado Thiago Valiati, especialista em direito administrativo e sócio do escritório Razuk Barreto Valiati.

Quem são os influenciadores que fazem os sorteios?
Entre os criadores de conteúdo que promovem os sorteios estão Emerson Falkevicz, que tem 6,1 milhões de seguidores no Instagram, e Willian Braz, que reúne 1,9 milhão.
Também conhecidos como Emerson Resolve e Willian da Bondade, eles publicam em suas páginas vídeos de doações em dinheiro ou em alimentos a pessoas que encontram nas ruas.
Os dois dizem que os sorteios são usados para arrecadar dinheiro para suas doações. Nas campanhas mais recentes, os influenciadores prometeram distribuir carros e celulares de luxo e oferecem o pagamento em dinheiro.
Os sites divulgados pelos dois influenciadores dizem que os sorteios são baseados nos resultados da Loteria Federal. Ambos afirmam que valor arrecadado será revertido em ações filantrópicas, mas não detalham as instituições que serão beneficiadas.
O g1 perguntou ao Ministério da Fazenda se as empresas Emerson Falkevicz, ligada ao influenciador, e Lorenza Empreendimentos e Desenvolvimento Pessoal Ltda., apontada como organizadora dos concursos de William Braz, tinham autorização para a realização de promoções comerciais. A pasta negou.
O g1 entrou em contato com os dois, mas não obteve retorno até a publicação desta reportagem. A página promovida por Falkevicz diz ainda que a campanha cumpre a lei por envolver um sorteio filantrópico que destina o que arrecada para “ajudar pessoas necessitadas com alimentos, educação, saúde”.

Entenda as regras para sorteios
A realização de sorteios, por si, não é ilegal. Porém, a prática deve cumprir uma série de requisitos estabelecidos pela Lei nº 5.768, de 1971, que trata da distribuição gratuita de prêmios. Entre vários pontos, a lei determina que:
os sorteios precisam de autorização do Ministério da Fazenda por meio do Sistema de Controle de Promoções Comerciais (SCPC), que permite consultar promoções em andamento por meio deste link;
não pode haver distribuição de prêmios em dinheiro;
a distribuição de prêmios só pode ser feita por pessoas jurídicas, como empresas e organizações da sociedade civil, e não por pessoas físicas;
os sorteios com fins beneficentes só podem ser realizados por organizações da sociedade civil que se dediquem exclusivamente a atividades filantrópicas;
os sorteios devem obedecer aos resultados da extração das Loterias Federais.
Os sorteios voltados para causas sociais se enquadram nas chamadas “operações filantrópicas”, que têm requisitos mais rígidos, segundo Valiati.
“Por exemplo, deve haver prova de que a propriedade dos bens a sortear tenha se originado de doação de terceiros devidamente formalizada”, diz o advogado.
E o recurso arrecadado, necessariamente, precisa ser revertido para a atividade ao qual as entidades foram criadas.
“Não são autorizados sorteios que proporcionem lucros imoderados. E a autorização não pode ser utilizada para explorar de sorteios como forma de renda”, diz o advogado Gleibe Pretti, professor da faculdade Estácio.
Em qualquer modalidade de sorteio, é preciso dar informações claras aos participantes.
“A divulgação deve ser ampla e transparente, informando o regulamento, a data e o local do sorteio, e o contato de quem está organizando”, afirma Pretti.
A distribuição de prêmios sem autorização ou em desacordo com a regulamentação pode levar à cassação da autorização, à proibição de realização de sorteios por até dois anos e a multa de até 100% do valor total dos prêmios.

    Paid for the three day offer and with the confirmation of the subscription, got two mails from hornycontacts.com and loveaholics.com asking me to confirm my email. Didn’t pay attention and deleted them.
    I immediately canceled the subscription in flirt.com without any issue and on the last day it changed to a standard membership so since it was bs site, cancelled the account as well.
    So I was happy and watching a movie when I got an sms from my card provider telling me that I got a 71.78 euros charge from fry frtlsp.com. Never heard of them, so I called my card provider and cancelled my card and will request the return of the money as well.
    Then I realized that maybe these two websites also by some miracle signed me up to a paid subscription… so I logged in… had to recover the passwords because they were not the one I used in flirt.com… and surprise, loveaholics.com did signed me up for a paid subscription without me being aware (pretty sure that somewhere during the signing process in flirt there was something checked and didn’t pay attention.). So I had to cancel subscription and account in these two other sites.
    So, sorry for the long post but in summary…. do not use flirt.com at all!!!
